(\u201cKevin Young Designers,\u201d \u201cKYD,\u201d \u201cwe,\u201d \u201cus,\u201d or \u201cour\u201d), we are committed to providing professional residential design services and high-quality house plans that meet our clients\u2019 needs.<\/p><p>Because our services often involve customized professional work, architectural and design development, consultation, digital documents, and other work performed specifically for each client, certain payments are non-refundable once work has begun.<\/p><p>This Refund Policy explains the circumstances under which payments may or may not be refunded.<\/p><h4>1. Custom Design Services<\/h4><p>Custom home design and remodel design services are personalized services performed specifically for each client and project.<\/p><p>Once KYD has begun work on a project, including design development, research, drafting, planning, revisions, or other professional services, payments associated with the work performed are generally non-refundable.<\/p><p>This includes, but is not limited to:<\/p><ul><li>Custom home design<\/li><li>Remodel design<\/li><li>Floor-plan development<\/li><li>Conceptual design<\/li><li>Design revisions<\/li><li>Drafting and documentation<\/li><li>Site-specific design work<\/li><li>Project consultation after work has commenced<\/li><li>Design development<\/li><li>Customized architectural or construction documents<\/li><\/ul><p>Any applicable deposit, retainer, or initial project payment will be applied toward the agreed scope of services and is generally non-refundable once work has commenced.<\/p><h4>2. Deposits and Retainers<\/h4><p>Deposits and retainers secure KYD&#8217;s time, resources, and availability for a project.<\/p><p>Unless otherwise stated in a written agreement, deposits and retainers are non-refundable once KYD has accepted the project and begun allocating resources or performing services.<\/p><p>If a project is canceled before KYD begins any work, KYD may, at its discretion, issue a partial or full refund after deducting any administrative costs or other expenses already incurred.<\/p><p>The applicable project agreement or proposal may contain different terms, which will control if there is a conflict with this policy.<\/p><h4>3. House Plans and Digital Products<\/h4><p>House plans, plan sets, drawings, digital files, PDFs, CAD files, and other downloadable or electronically delivered design materials may not be returned once they have been delivered or made available to the customer.<\/p><p>Accordingly, purchases of digital house plans or other digital design products are generally non-refundable after delivery.<\/p><p>This policy applies because digital files can be downloaded, copied, saved, or otherwise retained after delivery.<\/p><p>If you experience a technical problem accessing a purchased digital product, please contact us so we can work to resolve the issue.<\/p><h4>4. Custom or Modified House Plans<\/h4><p>House plans that have been modified, customized, revised, or otherwise prepared specifically for a customer are considered customized services.<\/p><p>Payments for customized plans or modifications are generally non-refundable once work has begun.<\/p><p>If you believe the delivered plans contain an error or do not match the agreed scope of work, please contact KYD promptly so that we can review the issue and, where appropriate, make a reasonable correction.<\/p><h4>5. Consultations<\/h4><p>Certain consultations may be offered at no charge, while others may require payment.<\/p><p>If a paid consultation is canceled sufficiently in advance and no consultation services have been provided, KYD may, at its discretion, provide a refund or credit.<\/p><p>Once a paid consultation has occurred or KYD has performed substantial preparation specifically for the consultation, the consultation fee is generally non-refundable.<\/p><p>Any cancellation or rescheduling terms communicated at the time of booking will also apply.<\/p><h4>6. Cancellation of a Project<\/h4><p>A client may request cancellation of a project at any time.<\/p><p>If a project is canceled after work has begun, the client remains responsible for payment for services performed and expenses incurred through the effective cancellation date.<\/p><p>Where applicable, KYD may calculate the final amount due based on:<\/p><ul><li>Work completed<\/li><li>Design development performed<\/li><li>Drafting and documentation completed<\/li><li>Revisions completed<\/li><li>Consultant or third-party costs<\/li><li>Materials or services purchased for the project<\/li><li>Other approved project expenses<\/li><\/ul><p>Any remaining balance, if applicable, will be handled in accordance with the project agreement.<\/p><h4>7. Refunds for Duplicate or Erroneous Payments<\/h4><p>If you believe you have been charged more than once for the same service or that a payment was processed incorrectly, please contact us promptly.<\/p><p>After reviewing the transaction, KYD may issue a refund for verified duplicate or erroneous charges.<\/p><h4>8. Dissatisfaction With Design Services<\/h4><p>We encourage clients to communicate with us throughout the design process so that concerns can be addressed as early as possible.<\/p><p>A client\u2019s change of mind, change in personal circumstances, change in budget, decision not to build, decision to use another designer or contractor, or dissatisfaction with a design preference does not automatically qualify the client for a refund.<\/p><p>Where reasonable, KYD may work with the client to address concerns through revisions or other solutions permitted under the applicable project agreement.<\/p><h4>9. Errors or Deficiencies in Services<\/h4><p>If you believe that KYD has failed to deliver an agreed service or that delivered materials contain an error attributable to KYD, please contact us promptly.<\/p><p>We will review the matter and, where appropriate, may correct the error, provide a revision, or offer another reasonable resolution consistent with the applicable agreement.<\/p><p>Any such remedy will be determined based on the circumstances of the project and the services purchased.<\/p><h4>10. Refund Review Process<\/h4><p>All refund requests will be reviewed individually.<\/p><p>If a refund is approved, KYD will generally process the refund using the original payment method whenever reasonably possible.<\/p><p>The time required for a refund to appear in your account may depend on your bank, credit-card company, payment processor, or other financial institution.<\/p><p>KYD is not responsible for delays caused by third-party financial institutions or payment processors.<\/p><h4>12. Non-Refundable Services and Expenses<\/h4><p>Unless otherwise agreed in writing, the following are generally non-refundable once provided, delivered, purchased, or initiated:<\/p><ul><li>Completed design services<\/li><li>Design deposits and retainers after work has begun<\/li><li>Custom design work<\/li><li>Drafting and plan development<\/li><li>Completed revisions<\/li><li>Customized house plans<\/li><li>Digital house plans after delivery<\/li><li>Downloadable files after delivery<\/li><li>Consultation services after they have been provided<\/li><li>Third-party services or expenses incurred on behalf of a client<\/li><li>Permit-related or consultant expenses already incurred<\/li><li>Other project-specific costs already paid or committed by KYD<\/li><\/ul><h4>13. Chargebacks and Payment Disputes<\/h4><p>Before initiating a chargeback or payment dispute with a bank or payment provider, we ask that clients contact KYD so we have an opportunity to review and resolve the issue.<\/p><p>A chargeback does not eliminate a client&#8217;s contractual obligation to pay for services already provided or expenses already incurred.<\/p><p>KYD reserves the right to provide applicable project agreements, invoices, communications, service records, and other documentation to a payment processor or financial institution when responding to a disputed transaction.<\/p><h4>14. Exceptions<\/h4><p>Nothing in this Refund Policy is intended to limit any rights or remedies that cannot legally be waived under applicable law.<\/p><p>Where applicable law requires a refund or provides consumers with a non-waivable cancellation right, KYD will comply with those requirements.<\/p><h4>15. Changes to This Refund Policy<\/h4><p>Kevin Young Designers may update this Refund Policy from time to time to reflect changes to our services, payment practices, business operations, or applicable legal requirements.<\/p><p>When changes are made, we will update the \u201cEffective Date\u201d at the top of this policy.<\/p><h4>16.
